Suppmatch Application Terms and Conditions

A.Definitions
These Terms and Conditions specify the general rules for using the services provided by the Service Provider, including conditions for activating and using an Account. The following terms, when capitalized in this document, have the meanings defined below unless explicitly stated otherwise in the context:
SuppMatch Sp. z o.o., with its registered office in Warsaw (00-609), at Aleja Armii Ludowej 26, 00-609 Warsaw, registered in the Register of Entrepreneurs maintained by the District Court for the Capital City of Warsaw, 12th Commercial Division of the National Court Register, under KRS number 0000845451, NIP: 7010986130, REGON: 386261508 with a share capital of PLN 5000 email: kontakt@suppmatch.ai;
a mobile application operating on portable devices with iOS and Android operating systems, provided by the Service Provider free of charge;
a natural person aged 13 or older who uses the Application. A User can use the Application upon creating an Account;
a space provided to the User within the Application under the Service Agreement, enabling the User to utilize services offered by the Service Provider through the Application;
minimum technical requirements necessary for using the SuppMatch Application and concluding the Service Agreement, as specified in Annex 1 to these Terms and Conditions;
an agreement to use the Application, concluded under the terms specified in these Terms and Conditions, between the Service Provider and the User upon installation of the Application, governing how the User may utilize the Application;
an electronic device capable of processing, receiving, and sending data, such as a smartphone, tablet, mobile phone, laptop, etc.;
a space made available to the User within the Application in accordance with the Service Provision Agreement, allowing the User to use the services offered by the Service Provider via the Application.
a questionnaire made available to the User within the Application, containing information about the User’s lifestyle, daily functioning, physical characteristics, and goals the User intends to achieve using Products. Completing the questionnaire enables an Analysis to provide the User with SuppMatch Recommendations;
a verification process of the User’s Physical Profile, scientific data, and Product properties to match Products to the User’s individual needs;
a proposal of Products tailored to the User’s needs as a result of the Analysis. The SuppMatch Recommendation includes details such as the type of recommended Product, a description of its effects, and the gross price (including VAT);
an item available in the Application's database;
this document defining the rules for Account activation and use, as well as the terms of providing and utilizing the services offered by the Service Provider to Users. These Terms and Conditions define the rights and obligations of the User and the Service Provider. Concerning electronic services, these Terms and Conditions constitute the regulations referred to in Article 8 of the Act of 18 July 2002 on the Provision of Electronic Services;
B.General Information
- These Terms and Conditions specify the rules for using the SuppMatch Application, including the creation and maintenance of an Account.
- Use of the Application requires the User's terminal device and telecommunication system to meet the minimum Technical Requirements specified in Annex 1 to these Terms and Conditions.
- Acceptance of these Terms and Conditions is voluntary but necessary to create an Account
- All content within the Application, including SuppMatch Recommendations, is for informational purposes only and does not constitute or replace medical or pharmaceutical advice. In particular, they should not be interpreted as providing medical services or health benefits as defined under the Polish Act of 15 April 2011 on Medical Activities or the Polish Act of 5 December 1996 on the Professions of Doctor and Dentist. These do not serve as a basis for diagnosis or treatment selection.
- The detailed scope of services is specified in subsequent sections of these Terms and Conditions.
C.Conclusion of the service agreement
- The Service Provider offers the following services via the Application:
a. enabling Account creation (Account establishment and maintenance service);
b. password recovery for the Account;
c. completion of the User’s Physical Profile and the ability to update entered data;
d. conducting the Analysis;
e. providing the User with SuppMatch Recommendations via the Application; - To use the Application, the User must create an Account.
- To create an Account, the User must:
a. provide necessary information, including their name, email address, and password (the password must be at least 8 characters long and contain at least one uppercase letter, one lowercase letter, and one number); or
b. link the Account with their Apple or Google Account. - To finalize Account creation, the User must review and accept these Terms and Conditions and the Privacy Policy. In the case of item 3(a) above, the User must also verify their email address by entering the verification code sent by the Service Provider.
- The Service Agreement is concluded once the User accepts the Terms and Conditions and Privacy Policy or, in the case of item 3(a) above, additionally verifies their email address by entering the verification code.
- The User may delete their Account at any time by contacting the Service Provider or independently. No charges apply for deleting the Account.
- Independent Account deletion is possible through the appropriate option within the User’s Account in the SuppMatch Application, followed by on-screen instructions.
- Deleted Accounts are immediately removed upon confirmation via a link sent to the User.
- Deleting the Account terminates the Service Agreement regarding Account maintenance. Orders placed prior to deletion will be fulfilled. Account deletion results in permanent loss of access to its content.
- The Service Provider agrees to provide the services specified in item 1 above in accordance with the terms set forth in these Terms and Conditions.
- The recording, securing, making available and confirmation of the essential provisions of the Service Agreement to the User shall be made in the form of an e-mail message (conclusion of the Service Agreement).
- The Service Agreement is concluded for an indefinite period.
- In order to ensure the proper implementation of the Service Agreement, the User is obliged in particular to:
a. promptly update data, including personal data, provided to the Service Provider in connection with account registration and the conclusion of the Service Agreement;
b. use the services offered by the Service Provider in compliance with applicable laws, the provisions of the Terms of Service, and the Privacy Policy, as well as generally accepted practices and principles of social coexistence, in a manner that does not inconvenience other Users or the Service Provider, and does not disrupt the operations of the Service Provider. - The User is also obligated to:
a. refrain from delivering or transmitting content prohibited by applicable law, particularly content infringing third-party intellectual property rights or personal rights;
b. abstain from actions such as:
i. uploading content that violates the law (prohibition of unlawful content);
ii. engaging in IT or other activities aimed at accessing information not intended for the User, including the data of other Users;
iii. unauthorized modification of content provided by the Service Provider;
iv. abusing rights granted to the User by the Service Provider or under the law, in a manner inconsistent with the socio-economic purpose of those rights or the principles of social coexistence.
- Violation of any of the obligations specified in Sections 13 or 14 above constitutes a material breach of these Terms of Service.
D.Termination of the service agreement
- The User may terminate the Service Agreement with immediate effect at any time by contacting the Service Provider.
- The Service Provider may terminate the Service Agreement with the User at any time with at least 14 days' notice for important reasons, defined exclusively as (exhaustive list) material breach of the Terms of Service by the User, or permanent cessation of electronic service provision by the Service Provider for objective reasons.
E.Application operation rules
- After installing the Application on a Device and registering an Account, the User should complete their Physical User Profile.
- Completing the Physical User Profile is free and voluntary but necessary to conduct the Analysis and receive the SuppMatch Recommendations.
- The Physical User Profile consists of the following User data:
a. date of birth;
b. current weight;
c. current height;
d. gender;
e. health areas the User seeks to improve through the Products;
f. physical activities engaged in by the User;
g. frequency, intensity, and duration of the physical activities mentioned in (f), if provided;
h. type of diet followed by the User;
i. food intolerances, allergies, or sensitivities;
j. daily hydration level;
k. frequency of alcohol consumption (weekly);
l. average sleep duration;
m. current stress level;
n. preferred supplementation method. - The User inputs the data specified in point 3 by selecting one or more options provided in the Application, depending on the data type being completed. The data provided by the User must be accurate, complete, and pertain exclusively to the User. The User is responsible for the accuracy and completeness of the data entered into the Application, including the Physical User Profile data.
- After completing the Physical User Profile, an Analysis is conducted, and the User receives SuppMatch Recommendations.
- The Service Provider may enable the User to access the seller’s website offering the Products included in the SuppMatch Recommendations for purchase.
- The User can repeat the Analysis to receive new SuppMatch Recommendations without re-entering the Physical User Profile data.
- The User can update the Physical User Profile at any time.
- The User is obligated to update the data specified in point 3 if any changes occur, particularly before placing a subsequent Order.
F.Complaints procedure
- The User has the right to submit complaints regarding services provided by the Service Provider at any time.
- Complaints may be submitted in writing or via email to the address: kontakt@suppmatch.ai.
- To expedite processing, the User may include the following information:
a. User’s data, email address and order number;
b. a description of the subject of the complaint. - Complaints will be processed no later than 14 days from receipt.
G.Personal data
All information regarding the protection of personal data is outlined in the Privacy Policy, available here: Privacy Policy.
H.Liability
- As the owner and manager of the Application, the Service Provider will make every effort to ensure the Application and all services provided via it operate continuously without disruptions. However, the Service Provider is not liable for disruptions caused by force majeure, hardware failure, or unauthorized User interference, which are beyond the Service Provider's control.
- The Service Provider reserves the right to temporarily disable the Application partially or entirely for improvement, new service additions, or maintenance, with prior notice to Users (technical downtime).
- The User bears full responsibility for legal violations or damages caused by their activities within the Application.
I.Amendments to the terms of service
- The Terms of Service come into effect on 1.01.2025 r. and are available within the Application and at the website www.suppmatch.ai/terms-conditions.
- The Service Provider reserves the right to amend the Terms of Service for the following important reasons (exhaustive list):
a. changes to laws governing electronic services affecting rights and obligations under the Service Agreement;
b. the need to adapt the Service Provider's activities to orders, rulings, provisions or guidelines resulting from:
i. a decision of a public administration body competent in the scope of the Service Provider's activities affecting the mutual rights and obligations specified in the Service Agreement concluded between the User and the Service Provider;
ii. a court decision applicable to the Service Provider's activities affecting the mutual rights and obligations specified in the Service Agreement concluded between the User and the Service Provider;
c. a change in the method of providing services electronically by the Service Provider caused exclusively by technical or technological reasons (in particular updating the Technical Requirements);
d. a change in the scope or principles of providing services by the Service Provider to which the provisions of the Terms and Conditions apply, by introducing new, modifying or withdrawing by the Service Provider the existing functionalities or services covered by the Terms and Conditions and offered to Users;
e. a merger, division or transformation of the Service Provider or a change in other data of the Service Provider. - In case of amendments, Users may terminate the Service Agreement within 14 days from receiving notice of the amendments with appropriate advance notice.
- In the event of changes in the Terms and Conditions, the Service Provider will make the consolidated text of the Terms and Conditions available by publishing on the Application website and by means of a message sent to the email address provided by the User.
J.Final provisions
- The governing law for the Service Agreement is the law of the Republic of Poland, and disputes will be resolved by common courts in Poland unless otherwise required by mandatory legal provisions. Any disputes between the Service Provider and the User who is not a consumer shall be submitted to the court having jurisdiction over the seat of the Service Provider..
- Choice of Polish law based on the Terms and Conditions does not deprive the consumer of the protection granted to him under the provisions that cannot be excluded by way of an agreement between the Service Provider and the consumer, under the law that, in accordance with the relevant regulations, would be applicable in the absence of choice.
- The Terms of Service are available to Users free of charge at www.suppmatch.ai/terms-conditions where they can be viewed and printed.
